Terms and Conditions of Sale

1. Purpose

These Terms and Conditions of Sale govern the sale of digital services, SaaS subscriptions and, when available, physical products offered by BL Prog.

2. Covered services

  • Website creation
  • Web applications
  • Mobile applications
  • Custom software
  • SaaS subscriptions
  • Physical products such as POS devices and thermal paper rolls

3. Order

An order may be initiated through the website, a form, a written exchange, a quotation, an invoice or any other confirmation accepted by the parties.

4. Quotation and validation

For custom services, a quotation or proposal may specify the scope, price, estimated timeline and deliverables. Written approval or full or partial payment constitutes acceptance.

5. Pricing

Prices are indicated according to the offer, currency and nature of the service or product. BL Prog reserves the right to modify its prices for future orders.

6. Payment

Payments may be made by bank card, Mobile Money for eligible African countries, or any other method communicated to the client.

7. SaaS subscriptions

SaaS solutions offered by BL Prog may operate on a monthly subscription, a free trial period or a specific offer. Unless otherwise stated, access to the service depends on effective payment of the subscription.

8. Free trial

The free trial allows the service to be tested for a defined period. Once the trial expires, access may be limited, suspended or subject to a paid subscription.

9. Delivery of digital services

Delivery times for digital services are estimates unless otherwise agreed in writing. Any delay caused by missing information, content, approvals or access to be provided by the client may not be attributed to BL Prog.

10. Physical products

Physical products will be offered subject to availability. Delivery conditions, availability, pricing and warranties will be specified at the time of order.

11. Cancellation and refunds

For custom services that have already started, amounts paid may be non-refundable unless otherwise agreed in writing. For SaaS subscriptions, non-use of the service does not automatically entitle the client to a refund. For physical products, returns will be handled according to the product's condition, the time of request and the conditions communicated at the time of sale.

12. Client obligations

The client must:

  • provide accurate information;
  • respect validation deadlines;
  • not use the services for illegal activities;
  • pay amounts due;
  • protect access credentials.

13. Liability

BL Prog undertakes to provide its services with seriousness and diligence. However, BL Prog cannot guarantee that a service will be entirely free from interruption, error or incompatibility linked to external factors.

14. Intellectual property

Unless otherwise agreed in writing, elements created specifically for the client may be assigned after full payment. Pre-existing tools, components, libraries, methods, models and know-how remain the property of BL Prog or their respective owners.

15. Data

Data collected in the context of sales is processed in accordance with the Privacy Policy.

16. Force majeure

BL Prog may not be held liable for any delay or failure resulting from an event reasonably beyond its control.

17. Governing law and dispute resolution

These terms are interpreted in accordance with the rules applicable in the Democratic Republic of the Congo, unless mandatory provisions require otherwise. The parties will seek an amicable resolution before any formal proceedings.
